Non-Molestation Order

What is a Non-Molestation Order?

A Non-Molestation Order is issued in the Family Law 1996 by the family court. It also does not allow an abuser (the respondent) to use or threaten violence, intimidate, harass or pester the applicant (the victim). The order may also make the abuser unable to approach the victim or victimise them either directly or indirectly via messages, calls, or social media and also to approach their residence, workplace or children’s school.

What is the duration of a non-molestation order?

Depending on the facts of the case, the court determines the length of the period of the order. Orders are normally six months to a year, although they can be renewed where necessary. Violation of Non-Molestation Order is a criminal offence, and is punishable by a term of up to five years imprisonment, or a fine, or both.

The Application Process

An application may be made without giving notice to the abuser (a so-called without notice application) in urgent situations to afford the abuser immediate protection. After being granted, the order becomes effective upon serving the respondent with the order. The court will then fix a hearing to determine whether the order will be sustained in the long run.
