Specific Issue Orders

Specific Issue Order (SIO) is a court order taken in accordance with Section 8 of the Children Act1989. It assists in the resolution of disputes among parents or guardians concerning specific areas of upbringing of a child. In some cases where parents are unable to negotiate on a very important decision that would impact on their child, the court comes to the rescue and decides what is the best course of action to a given child.

In contrast to general child arrangement disputes that revolve around the residence of a child or the frequency with which the child visits each parent, an SIO relates to a single issue that has led to a dispute.

Who is Eligible to apply to a specific Issue Order?

Any individual who has the parental responsibility of the child may apply. In other instances, the role of the grandparent, guardian or step-parent in the life of the child may also apply though they may have to seek the consent of the court.

How the Court Decides

The welfare of the child is the major consideration when the court goes through an SIO application. The Children Act of 1989 provides the welfare checklist used by the judges that entails:

The court also closely examines evidence presented by both parties and might also pay attention to Cafcass (the Children and Family Court Advisory and Support Service) reports prior to making a decision.

Mediation

The Role of Mediation

In court, parents need to attempt mediation or some other kind of dispute resolution. This method will help to prevent a lengthy process in court and promote collaboration. Mediation might fail or the issue is pressing and a court application might be required.
