Can I apply for Settlement on a Skilled Worker Visa?
If you remain in the UK on a Skilled Worker Visa for five years and do not break any immigration laws during that time, you may be able to apply for Indefinite Leave to Remain. There are several additional requirements you must meet to obtain Settlement, including passing the Life in the UK test and complying with the continuous residence rules. The latter means you must not be absent from the UK for more than 180 days in any given 12-month period during the five-year qualifying period.

Can I bring my family with me to the UK?
Yes, you can bring your dependent family members with you. A dependent family member is your spouse or partner and dependent children under 18 years. You can bring your child if they are over 18 years and currently living in the UK and dependent on you

Your spouse or partner must prove that:

  • They are married to you, or you are both in a civil partnership. Your marriage or civil partnership must be recognised in the UK.
  • You have been living together in a relationship for at least two years.

  • Can I set up a business in the UK and sponsor myself for a Skilled Worker Visa?
Under the Skilled Worker Visa eligibility requirements there is no limit to how many shares an applicant owns in a UK company. Therefore, in theory, it is possible for an applicant to own 100% of a business and employ themselves. However, you will need to obtain a Sponsor Licence, a process which may be challenging if you are not present in the UK. Our Business Immigration Solicitors can assist you with applying under this route.
