What is a human rights appeal in immigration law?
A UK human rights appeal in immigration cases refers to the legal process undertaken when someone believes their human rights have been violated by a decision of the UK Home Office regarding their immigration status. The appeal is made to the First-tier Tribunal (Immigration and Asylum Chamber) (the Tribunal).
The European Convention on Human Rights (ECHR) is incorporated into UK law by the Human Rights Act 1998 and provides several fundamental rights that must be respected by public bodies, including UK Visas and Immigration (UKVI). The most invoked rights in immigration cases are:
- Article 3 – prohibits the use of torture and inhuman or degrading treatment.
- Article 8 – the right to respect for your private and family life.
If you believe your rights under these or other provisions of the ECHR have been violated, you can appeal against a UKVI decision. You must lodge your appeal within 14 days of the decision (or 28 days if you're outside the UK), though exceptions can be made in certain circumstances.
How do I make a human rights appeal?
