What are the requirements of a valid Will?
For a Will to be valid, it must be:

• in writing
• signed by the person who made the Will (known as the Testator), or by some other person in the Testator’s presence and by their direction, and in the presence of at least two witnesses who are both in the room with the Testator at the same time
• signed by the witnesses in the presence of the Testator, but not necessarily in the presence of each other
• each of the witnesses must be over the age of 18, independent, and must not benefit from the Will

Why should I instruct a Solicitor when I can buy a Will template online?
Although it is possible to draft your own Will using a DIY template, if you have significant assets such as your own property/s, a family business, stocks and shares, or vulnerable family members who you want to benefit from the Will, expert advice is essential to ensure you are aware of things such as tax implications and how to deal with your digital estate (for example, your business’s website.
