At First Law Solicitors, we represent individuals, families, and businesses challenging unfair or unlawful Home Office decisions before the First-tier Tribunal (Immigration and Asylum Chamber) and the Upper Tribunal.
An immigration appeal is more than a procedural challenge; it is a chance to reframe your case with precision, evidence, and expert advocacy. Our solicitors prepare each appeal as a complete legal and factual reconstruction of your position, using both human rights law and the latest digital verification systems under the Data Use and Access Act 2025 (DUAA).
Appeal rights in 2026 are more limited than they were a decade ago, but several key areas remain fully appealable:
If your decision does not carry a statutory right of appeal, our solicitors can often pursue Administrative Review or Judicial Review instead.

Since the implementation of the Tribunals (Procedure) Rules 2025, immigration appeals now operate almost entirely through digital systems integrated with DUAA verification.
Lodging the Appeal
Appeals are filed through the MyHMCTS digital platform. You must submit your appeal within the statutory deadline after the decision, normally 14 days if you are inside the UK.
Our solicitors ensure all appeal notices, witness statements, and supporting documents are digitally verified and signed with Qualified Electronic Signatures (QES), ensuring compliance with the new 2026 standards.
Case Management and Directions
The Tribunal will issue digital directions via your online account.
The 2025 Rules require early exchange of all evidence, with mandatory disclosure of Home Office bundle references and DUAA data checks.
Hearing Options
Appeals may be determined through one of three formats:
Our team prepares every appeal to succeed under any format, ensuring the judge has immediate access to a concise, evidence-focused digital bundle.
A successful appeal depends on more than re-submitting old evidence. It requires a complete forensic rebuild of your case.
At First Law Solicitors, we undertake:
1. Legal Ground Analysis
We identify the exact statutory and human rights grounds on which the refusal was made and frame your appeal to address them directly.
2. Evidential Reconstruction
We obtain new, stronger evidence, including DUAA data downloads, HMRC records, and independent expert reports that can withstand both digital and in-person scrutiny.
3. Tribunal Advocacy
Our solicitors and barristers present your case with precision, anticipating the legal and factual arguments likely to be raised by the Home Office Presenting Officer.
4. Post-Hearing Strategy
If the Tribunal decision is adverse, we immediately assess prospects for an Upper Tribunal appeal or a Judicial Review, ensuring there is no gap in representation.
Spouse and Family Visa Appeals
Refusals often arise from alleged inconsistencies in financial documents or doubts about relationship genuineness. We address these by aligning evidence with DUAA records and bank verification.
Asylum Appeals
We prepare detailed country reports, psychological assessments, and corroborative witness statements, focusing on credibility and risk on return.
Human Rights Appeals
Our submissions integrate Article 8 ECHR case law and modern proportionality analysis, including the best interests of children under Section 55 of the Borders, Citizenship and Immigration Act 2009.
Deportation Appeals
We build comprehensive evidence around rehabilitation, integration, and family life, using the DUAA system to demonstrate positive contribution and continuous employment.
The Data Use and Access Act 2025 has redefined immigration litigation in 2026.
The Home Office, HMCTS, and the Tribunal now share digital access to:
This means the Tribunal already has access to key facts before your hearing.
At First Law Solicitors, we ensure that your case is digitally aligned with these records so the judge sees a consistent, verified picture from the outset.
If you do not have a right of appeal, or your appeal has been dismissed, you may still have further legal options:
Administrative Review: For cases where the error is procedural or factual within the Home Office’s own process.
Upper Tribunal Appeal: For errors of law in the First-tier Tribunal decision.
Judicial Review: For cases where no statutory right of appeal exists but the Home Office has acted unlawfully or irrationally.
We assess every case individually to determine the most effective, proportionate strategy to achieve a positive outcome.
Strategic Case Reconstruction
We rebuild every appeal from the ground up, combining legal argument with forensic evidence review.

Every Tribunal case is overseen by a senior solicitor with direct experience before the Upper Tribunal and the Court of Appeal.
