Statutory Declarations

Professional Solicitor Witnessing and Certification

At First Law Solicitors, we provide professional witnessing and certification of Statutory Declarations for individuals, businesses and public bodies across the United Kingdom.

A statutory declaration is a formal statement of fact confirmed to be true before a solicitor or commissioner for oaths. It is commonly used in legal, administrative and personal matters where written evidence must be verified by law.

Our solicitors ensure that your declaration is properly prepared, witnessed and certified in compliance with the Statutory Declarations Act 1835, so it can be accepted by courts, government departments, banks, embassies and other authorities.

Statutory Declarations

Understanding Statutory Declarations

A statutory declaration is a written statement confirming that certain information is true to the best of your knowledge and belief. It is similar in form to an affidavit but does not require an oath. Instead, you make a solemn declaration that the contents are true.

You may be asked to make a statutory declaration for a range of purposes. These include confirming personal details, declaring ownership of property or assets, proving identity or residence, confirming the loss of documents, or providing evidence in visa or immigration applications.

Public authorities, companies and foreign embassies frequently require statutory declarations because they are legally recognised as truthful statements. Making a false declaration is a criminal offence, so accuracy and care are essential. Our solicitors ensure that your document is drafted correctly, that you understand its effect, and that the formal declaration is properly administered.

The Solicitor’s Role

When you attend your appointment, our solicitor will review the declaration and confirm that it follows the correct format. We will check your identity, ensure that you understand what you are declaring, and then invite you to make the declaration aloud before signing it. The solicitor will then sign and stamp the document to confirm that the declaration has been duly made before an authorised person.

If you have already prepared a declaration, we can witness and certify it as drafted. If you require help preparing one, we can assist with drafting the correct wording so that it meets the requirements of the organisation or authority requesting it.

Our role is to ensure that the process is legally compliant. We do not comment on the truth or content of the declaration itself.

Digital and Remote Declarations

Since 2025, statutory declarations can also be witnessed and certified digitally under the Digital Verification Services (DVS) framework.

Our solicitors can verify your identity and administer the declaration through a secure video appointment, using Qualified Electronic Signatures (QES) to certify the process where accepted by the requesting authority.

This service is especially useful for clients located abroad or unable to attend in person. All digital declarations are recorded and securely stored, providing clear proof of authenticity and compliance with UK evidentiary standards.

Data Protection and Confidentiality

We treat all personal information and documents with strict confidentiality.

Every record is handled and stored in accordance with UK GDPR and the Data (Use and Access) Act 2025, under the supervision of the Information Commission (formerly the ICO).

Original papers are reviewed and returned immediately after signing, and all certified digital records are stored securely within our encrypted systems.
